The Court of Appeal has confirmed the decision of the Basic Court in Pristina on the innocence of the former Minister of Health, Ferid Agani, and the former Secretary of this Ministry, Gani Shabani, in the "Stenta 1" case.
In a decision published by the Appeal, it is known that the appeal of the Special Prosecution was rejected as unfounded. The appeal has assessed that the judgment of the Foundation does not contain an essential violation of the provisions and that there is no contradiction in itself nor with its reasons.

The former Minister of Health, Ferid Agani and Gani Shabani, were found guilty of abuse of official position in April 2019. But after appeals, this judgment was annulled by the Court of Appeal in December 2019 and the case was returned to a retrial. in the first degree.
Due to the large number of accused in February 2018, the 'Stenta' case was divided into three parts, the accused Agani and Shabani are tried separately in the 'Stenta 1' case, over 40 public hospital doctors are accused in the case known as 'Stenta 2', while the owners and doctors of private hospitals are part of the 'Stenta 3' case.
On June 15, 2016, the State Prosecutor's Office filed an indictment against Ferid Agan, Gani Shabani and 62 other persons, for the criminal offenses of "abuse of official position or authority", "taking a bribe", "giving a bribe", "treatment medically unconscionable", "illegal exercise of medical and pharmaceutical activity" and "tax avoidance".
