The Government has been called upon to stop the attacks on the Constitution

The accusation of a number of government officials against the judges of the Constitutional Court, who overturned several laws this week, has provoked reactions. In civil society, they emphasized that such attacks shake the values ​​of democracy and will be reflected in the periodic international reports that are made about Kosovo.

A number of government officials have criticized and labeled the judges of the Constitutional Court, after this week this institution overturned several laws and decisions.

The court also declared unconstitutional the Law on the State Bureau for the Verification and Confiscation of Unjustifiable Assets, which is considered the most important law of the Kurti Government.

After the announcement of this, the Minister of Justice, Albulena Haxhiu, accused the judges of, as she said, serving the old nomenclature. 

Similar accusations have been launched by other Government officials.

This approach of the governors has provoked reactions. 

In a communique of the American Chamber of Commerce of Kosovo, it is stated that such statements violate the institutions and are unacceptable, since, according to it, they violate the principle of separation of powers and erode democratic values.

"It is the duty of all stakeholders and political officials to respect the constitutional and legal framework of the state. This includes not only performing functions and fulfilling their responsibilities, but also maintaining the independence of other institutions. Formulating policies, building consensus, drafting legislation and revising legal acts must be done within the limits of respecting the independence of the judiciary", states the reaction of the American Chamber of Commerce of Kosovo.

E, the lawyer and connoisseur of developments in the justice system, Yll Zekaj, says that the actors of the Government are attacking every link of the justice system.

"It is not the first time that we see such a reaction or attack by the Government towards independent institutions, such as the Constitutional Court. In the past, we have seen continuous attacks by this government also in the direction of the regular courts, every time they did not like or did not agree with such a decision", said lawyer Zekaj.

According to Zekaj, such attacks will be reflected in the international reports that are made about Kosovo.
On Wednesday, the Court declared invalid in its entirety the Law on the State Bureau for Verification and Confiscation of Unjustified Assets. With five votes in favor and four against, it found that five essential articles of the law conflict with the Constitution.
